'Opening Contest 2024' prize competition - rules of conduct

§ 1 General provisions

 

  1. The organiser of the prize competition titled "Grand Opening Contest" hereinafter referred to as the Competition is Beauty Brands Concept sp. z o.o. with its registered office in Poland, Lesznowola (05-506), ul. Żytnia 19, NIP: 1251586587, REGON: 142738307, hereinafter referred to as the Organizer.
  2. The Competition is organized in the territory of the European Union member states and is conducted on the Internet via the website available at the URL: https://eveline.eu
  3. The Competition starts on 02.09.2024 and ends on 30.09.2024, inclusive. Submissions reaching the Organizer after the deadline will not be considered.
  4. The terms used in these Rules shall mean:
    1. Participant - a User who meets the criteria and applies to participate in the Competition;
    2. Review – the work to be created and delivered to the Organizer by the Participant in the Curse of the Competition
    3. Rules - these rules of conduct, available at the Organiser's office and on the website https://eveline.eu
    4. User – the person registered with the Website as its user;
    5. Winner - the Participant awarded the prize for his Review by the Competition jury.
    6. Website - the e-commerce service of the Organizer available at the URL: https://eveline.eu

 

§ 2 Who can participate in the Competition

 

  1. Only adult natural persons with full legal capacity being Users residing in the territory of the European Union member state may be Participants.
  2. The Participants may not be employees, legal representatives or other entities directly associated with the Organizer especially in terms of capital, organizational, or personal ties, as well as their siblings, spouses, ascendants, descendants, and persons in their care.
  3. The Competition can be participated only in person.
  4. By taking part in the Competition, the Participant declares that he meets the criteria which entitle him to be the one, accepts unreservedly these Rules, as well as agrees to publish the Review as the award-winning one along with his name and surname or nickname on the Organizer's social media profiles (Facebook) and on the Website.

 

§ 3 How to participate in the Competition

 

  1. Participation in the Competition is free and voluntary.
  2. The person willing to be the Participant shall
    1. log to his User account or register as User on the Website
    2. by use of the User account purchase any Eveline Cosmetics product
    3. leave Review for the all purchased products on the Website by October 14, 2024 at the latest
    4. complete the entry form for the Competition
  3. Each Review is subject to moderation being the process of screening the Reviews for inappropriate, offensive, false or illegal content conducted Monday to Friday, lasting up to 24 hours, which may cause delays for the Review to be displayed in the Website. The Organizer reserves right to reject any non-compliant Review without further notice.
  4. The Participant may, at his own discretion, submit more than one Review, however
    1. only one per any order;
    2. only one per any of the following cosmetic products genre: lipsticks, mascaras etc.
    3. Notwithstanding the number of Reviews the Participant may win only one prize.
  5. Any review left on the Website not reported by the User as the Review taking part in the Competition shall be published on the website according to general Regulations governing the Website available at the Organiser's office and on the website https://eveline.eu

 

§ 4 The Reviews and how they are rated

 

  1. The Participant's task is to create and deliver to the Organizer the Eveline Cosmetics product review being a piece of text of no less than 30 words long, reporting the Participant’s life experience involving the Eveline Cosmetics product.
  2. The Organizer shall appoint a Jury consisting of two representatives of the Organizer being qualified marketing managers in the Organizer’s Marketing Department, who will select wining Reviews, taking into consideration primarily but not exclusively, listed here in random order, their creativeness, humour, word play and the Organiser's brand guidelines.
  3. The decisions of the Jury are final and cannot be appealed. Jury deliberations are confidential.

 

§ 5 Prizes and their delivery to the Winners

 

  1. The Jury will select:
    1. 5 Reviews each awarded the prize in the form of a Foreo accesories.
    2. 20 Reviews, each awarded the prize in the form of Eveline Cosmetics gift box.
    3. The value of the prize is the gross value i.e. including any national, domestic, local etc. taxes related to the prize save for the withholding tax referred to in Rule 5.5.
  2. The competition results will be pronounced on 21.10.2024 via the Eveline Cosmetics brand profile on www.facebook.com/EvelineCosmeticsEurope. Within the next 2 working days, the Organizer will contact each of the Winners via email informing him on the prize and inviting to submit data needed. The prizes will be delivered to Winners via email address used by them as Users on the date of delivery, within 30 calendar days from the day the Winner provides the Organizer with all the Winner’s data as follows:
    1. name and surname;
    2. contact email address
    3. residential address (street, building number, apartment number, postal code, city, state, province if applicable)
    4. tax office competent for the Winner
    5. tax number or other number used for identification in tax matters
    6. contact phone number
  3. Winners who fail to provide the data listed above to the Organizer within 10 days of receiving the notification of the prize allocation irreversibly forfeit the right to the prize. Prizes not collected by the Winners become the property of the Organizer and remain solely at his disposal.
  4. The prizes in the Competition are not exchangeable for any equivalent. The Winner may not transfer his right to receive the prize to any third party.
  5. An additional cash prize will be added to each prize, equal to the flat-rate personal income tax applicable to the prize at issue, calculated from the grossed-up amount of the prize (i.e., at a rate of 11.11% of the value of the prizes described in para. 1), which shall be deducted and remitted by the Organizer as the payer of the lump-sum personal income tax in accordance with Article 30 (1)(2) of the Polish Personal Income Tax Act of 26 July 1991.

 

§ 6 Copyrights and like rights

 

  1. By submitting the Review in the Competition the Participant declares that he owns any and all rights in this review in particular copyrights, author’s rights or like rights and that these rights are not limited or encumbered in any way, and that he is the sole author of the Review and that the Review otherwise does not violate any rights of any third person.
  2. By submitting the Review the Participant grants the Organizer a non-exclusive, unlimited in terms of time and territory, license to make use of the Review in the following fields of exploit:
    1. in terms of fixation and reproduction by any technique, including printing, reprographic, magnetic recording, and digital techniques;
    2. in terms of trade in the original or copies on which the work was fixed by introduction into circulation, lending, or rental of the original or copies;
    3. in terms of dissemination of the work by public performance, exhibition, display, reproduction, broadcasting, and rebroadcasting, as well as public provision of the work in such a way that everyone can access it at a place and time of their choosing (including sharing on the Internet and as part of any telecommunications services);
  3. The Winner consents for the Organizer, in exchange of the remuneration being the prize won in the Competition, to exercise the rights referred to above also by transformation, alteration, adaptation or translation of the Reviews in whole or parts; their multiple publication (including them being published along with the Participant's name, or surname) in promotional materials related to the Competition, as well as on the https://eveline.eu website and their use for further promotional and marketing purposes by the Organizer.

 

§ 7 Processing of personal data

 

  1. The personal data provided by Participants shall be protected as personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter RODO).
  2. The Administrator of the personal data is Beauty Brands Concept sp. z o.o. with its registered office in Poland, Lesznowola (05-506), ul. Żytnia 19, NIP: 1251586587, REGON: 142738307
  3. In matters related to the processing of personal data, the Participant contact the Administrator by e-mail at the dedicated e-mail address: info.eu@eveline.eu The Participant may also send Administrator a message, a request or a demand at correspondence address: Poland, Lesznowola (05-506), ul. Żytnia 19.
  4. In order to conduct the Competition, the Administrator will process data as follows: name and surname, contact email address, residential address (street, building number, apartment number, postal code, city, state, province if applicable), tax office competent for the Winner, tax number or other number used for identification in tax matters, contact phone number and image, if the image is the part of the Review.
  5. The Administrator will process the Participants’ personal data for the following purposes:
    1. conducting the Competition, determining the right to prizes, awarding them, transferring them to the Winners, publication of the Competition results - art. 6 sec. 1 letter a) RODO (consent expressed in the form of a clear action confirming participation in the Competition, transferring data in order to dispatch the prize);
    2. handling of complaints - Article 6(1)(c) RODO (fulfilment of a legal obligation incumbent on the Administrator);
    3. assertion of possible claims - Article 6(1)(f) RODO (legitimate interest assertion/defence of claims);
    4. fulfilment of tax obligations related to the awarding of prizes, the running of the Competition - Article 6(1)(c) RODO (fulfilment of a legal obligation incumbent on the Administrator);
    5. carrying out research, analysis, statistics - Article 6(1)(f) RODO (legitimate interest: market research, consumer needs/product demand investigation)
  6. Recipients of the Participants’ personal data may be entities rendering accounting services to the Organizer, dealing with computer equipment servicing, IT outsourcing, website and mail hosting, server delivery, organization of the Competition and its promotion, prize shipment, as well as entities entitled on the basis of legal regulations.
  7. In connection with the processing of personal data, the Participant shall have the following rights:
    1. the right to withdraw consent to data processing at any time - in this case, however, the Administrator informs that it will not be possible for the Administrator to perform the duties of the Organizer, including in particular allowing the Participant to participate in the Competition and receive the prize;
    2. the right of access to personal data and the right to request their rectification, erasure or restriction of their processing;
    3. the right to object to processing on the basis of legitimate interest;
    4. the right to data portability under the terms of the RODO;
    5. the right to lodge a complaint to the supervisory authority (the President of the Polish Office for Personal Data Protection)
  8. Personal data will be processed for the entire period of the organisation and running of the Competition, and thereafter:
    1. the right to withdraw consent to data processing at any time - in this case, however, in the scope of personal data processed on the basis of consent - until its cancellation by the Participant;
    2. in the scope of personal data processed on the basis of the legally justified interest pursued by the Administrator - until the Participant raises an objection to the processing of personal data;
    3. with regard to personal data processed in the event of the assertion of potential claims, until such time as the dispute is resolved, taking into account the relevant limitation periods for claims;
    4. with regard to personal data processed for the purpose of dealing with a complaint, until the complaint is dealt with;
    5. with regard to personal data used to carry out tax obligations, until the expiry of the statute of limitations for tax obligations, unless tax laws provide otherwise.
  9. The provision of personal data is voluntary. Failure to provide personal data may prevent however the Participant from taking part in the Competition and, in the case of Winners, from being delivered the prize.

 

§ 8 Complaints

 

  1. Any complaint concerning the way the Competition is carried out may be submitted by the Participants by e-mail or in writing.
  2. The complaint should include: name, surname and exact address of the Participant, as well as an exact description and reason for the complaint. Complaints should be sent to email: info.eu@eveline.eu or by post at correspondence address: Poland, Lesznowola (05-506), ul. Żytnia 19.
  3. Complaints will be considered within 7 days of their receipt by the Organiser.
  4. The Participant will be notified of the decision by registered letter sent to the address given in the complaint within 7 days from the date of complaint consideration. A reply to a complaint submitted by e-mail will be sent to the User at the e-mail address provided by the User in the complaint.

 

§ 9 Final provisions

 

  1. These Rules are governed by the law of the republic of Poland save for provisions that cannot be derogated from by agreement in the meaning of art. 6 (2) Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I).
  2. These Rules along with the relevant provisions of laws constitute the only source of information setting the principles of the Competition. Any promotional and advertising materials pertaining thereto are disseminated by the Organizer for information purposes only.
  3. These Rules do not impair the rights arising from general Regulations governing the Website available at the Organiser's office and on the website https://en.eveline.eu in particular the rights of the Organizer to the Website content.
